1. Acceptance of Terms
These Terms govern your use of BeforePeak ("we", "us", "our") and our booking platform. By accessing or using the platform, you agree to these Terms. If you do not agree, do not use the platform.
2. Service Description
BeforePeak enables customers to make restaurant reservations during off-peak hours at participating restaurants with an advertised 50% discount on eligible menu items. A booking fee is paid to secure the reservation. Restaurants remain responsible for food and service.
3. Eligibility
- You must be at least 18 years old or have parental consent to use the platform.
- You agree to provide accurate information and keep your account secure.
4. Pricing, Fees and Discount
- Booking fees are fixed by party size (HK$50–HK$120) and displayed at checkout.
- The 50% discount applies to most a la carte menu items unless excluded by the restaurant. Exclusions (e.g. beverages, set menus, promotional items, service charge) are shown during booking where provided by the restaurant.
- Service charge (if applicable) is calculated by the restaurant based on the discounted bill unless otherwise required by the restaurant.
5. Cancellations, No‑Shows and Credits
- Free cancellation up to 12 hours before the reservation time with full account‑credit refund of the booking fee.
- Late cancellation (under 12 hours) or no‑show: booking fee is forfeited.
- Account credits do not expire and are non‑transferable and non‑redeemable for cash.
6. Restaurant Responsibilities
- Restaurants are independent merchants responsible for food quality, safety, hygiene and service.
- Menu availability and exclusions are determined by each restaurant. In case of discrepancy, the restaurant’s in‑store policy applies.
7. User Responsibilities
- Arrive on time and present your booking confirmation to enjoy the discount.
- Use the booking for the specified party size and time window. Changes are subject to restaurant availability.
- Treat restaurant staff and other diners with respect and comply with house rules.
8. Disputes and Chargebacks
For any in‑restaurant disputes (food quality, service, bill computation), you should first resolve with the restaurant on site. For issues with booking fees or credits, contact BeforePeak support. Unfounded payment disputes or chargebacks may lead to account suspension.
9. Platform Role and Liability
We act as a booking facilitator and do not control restaurant operations. To the maximum extent permitted by Hong Kong law, we are not liable for indirect or consequential losses arising from dining experiences. Nothing in these Terms limits liability for death or personal injury caused by negligence or fraud.
10. Compliance with Hong Kong Law
- We aim to comply with the Trade Descriptions Ordinance (Cap. 362) and avoid misleading representations. Discounts and exclusions are stated transparently where provided by restaurants.
- Contract terms are interpreted subject to the Control of Exemption Clauses Ordinance / Unfair Contract Terms principles (Cap. 71). Nothing herein excludes statutory rights that cannot be excluded under Hong Kong law.
11. Personal Data and Privacy
We process personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486). See our Privacy Policy for details on collection, purpose of use (e.g. bookings, support, fraud prevention), retention and your access/correction rights.
12. Force Majeure
We and restaurants are not responsible for failure to perform due to events beyond reasonable control (e.g. severe weather, public health emergencies, governmental action, power outages).
13. Amendments
We may amend these Terms from time to time. Material changes will be notified via the site or email. Continued use after changes constitutes acceptance.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have exclusive jurisdiction over disputes.
